With all the video content on youtube that is not exactly above board, by that I mean, people putting up vidoes that they do not have the rights to, where does that leave me with regards to me using the embedded code and hosting the video on my site. Am I liable?

Embedded video is just you linking to YouTube, you're not hosting it yourself. So that would protect you.
