That's not a "W3 Guideline", it's a valid XHTML spec, assuming you choose to make your site XHTML valid. If you choose not to worry about XHTML then you don't need to worry about it.

It's not the same thing, that's the point. That tag is for valid XHTML (maybe HTML 4.0 or other upper class HTML as well, I'm unsure) but I do not believe that they've published anywhere that that tag is a must, unless you're trying to pass certain validation. If I'm wrong I'd like to see the page where that is a specified must use. Just so I know.
